These booking terms and conditions are applicable ONLY to Flights, Tailor Made or Package Holidays

Broadway Travel is an ABTA retail travel agent and as such acts as an intermediary in all holiday/flight transactions.

Broadway Travel act as agents only for the relevant supplier/tour operator shown on your documents (together with their ATOL number and booking reference locator where applicable). All terms and conditions of these principals will apply and are available upon request.

Errors and Omissions
We take reasonable steps to ensure that any information, photographs, or any other details about the flights, accommodation arrangements or accommodation featured on the website is accurate. Whilst every effort is made to ensure the accuracy of all information and prices displayed on this Site, regrettably errors do occasionally occur. In the event that an incorrect price has been entered in error, any booking made based on such incorrect price will not be valid. You will be advised of the mistake at the earliest opportunity and you will then have the option either to pay the correct price for the travel arrangements or to cancel and receive a full refund of any monies you may already have paid. We make no warranties or promises as to the availability or suitability of any accommodation advertised. We reserve the right to change or vary the price, flight, accommodation, or any other arrangements featured on our website at any time without notice. You agree that it is your responsibility to ensure that all the details of your chosen accommodation are confirmed with us at the time of booking.

Payments
We accept all major credit and debit cards. There is a charge of £1 for any bookings made using a debit card or switch card and a charge of 2.5% for any bookings made using a credit card.

Additional Charges
Please note that all additional charges are included in the total cost. Additional charges included airport taxes, fuel supplement, security fee and where applicable (when your flight is with a low cost airline) a card booking fee.

Your Obligations
Please ensure that ALL documentation is thoroughly read and understood. It is your responsibility to inform us of any discrepancies. Please note some suppliers may charge for amendments and unfortunately in these circumstances the client will be responsible for any additional charges. Please ensure that you arrive in good time for your departure, we cannot be held responsible for your failure to do so.

Transfers
There are no transfers included in your holiday cost unless otherwise stated. On arrival at your destination you will normally find taxis just outside the terminal building. To avoid getting overcharged it is advisable to agree a cost before you take the journey.

Inflight Meals/Baggage
Please note inflight meals are not included in the price stated (apart from if your flights have been booked with Custom Flights, Virgin and BA.com), however they are available at an additional cost. If you would like to include them to your reservation please contact one of our sales consultants on 0871 716 1040.

Baggage allowance can vary from airline to airline and range from no baggage allowance being included in the cost of the flight to 23kg with some scheduled airlines. Please contact customer services to clarify this. We do not accept responsibility for any excess baggage charges levied at the airport.

Requests
We will try to meet any special requests made of us, but cannot guarantee anything.

Travellers under 18
The person signing the booking form/completing the booking on-line accepts responsibility for paying for all the people on the booking. They are also responsible for keeping everyone in the party informed of the booking details. You must be at least 18 years old to make a booking with us. The first named person travelling on the booking must be at least 18, if all people travelling in your party are under 18 you need to provide a letter of consent from your parent or guardian, please either email this letter to customer.service@broadwaytravel.com or send to: Customer Service, Broadway Travel, Unit 1, Finway, Luton, LU1 1WE. Each airline and hotelier allows different ages to travel and stay at their accommodation so if you are under 18 years old then please check with us before booking.

Insurance
We must insist that it is a requirement that you are adequately insured for the holiday you have booked. Therefore if you have not taken insurance offered by Broadway Travel, then we will be grateful if you could advise us of your own arrangements. The information required has to include the name of the policy, the policy number and the emergency contact number. If you have arranged your insurance with Broadway Travel, then you will find a separate cover document, it is recommended that you take this with you. In the unlikely event that emergency assistance is required you will find the telephone number on the insurance document.

Car Hire
Please note that if you are hiring a car then you will need to supply a credit card as security when you collect the car. The credit card must be in the name of the lead driver, no money will be taken from the card without your consent (all details will be covered when you sign your agreements before taking the car).

In most destinations you need to be over 21 to hire/drive a car, it is always best to double check the age limit before booking.

Car Parking
If you have arranged to park a car at a pre-booked car park please ensure that you know which car park that you are to use. Please bear in mind that some airport car parks may involve a coach transfer. Please allow time for this.

Ticket on Departure
If you are collecting documentation from the airport, this will normally ONLY be your flight tickets. Please ensure that you have any other vouchers or insurance documents either posted or faxed to you before you depart.

Visa / Vaccinations
Certain countries require a visa permit for entry. Further information can be obtained from the embassy representing your destination. Where required, we recommend that all passengers have the correct vaccinations prior to travel. Always consult your doctor. Please Note: The U.S department of immigration has recently changed some of the rules for visitors entering the U.S.A, please contact us for more information, especially if you have a criminal record.

Flight Times and Tickets
All departure and arrival timings are given using the 24 hour system. Your flight tickets will state the most up to date flight time information, so please read them very carefully and ensure that you allow sufficient time to arrive at the airport, normally 2 hours before departure. Tour operators make it a responsibility of the traveller to re-confirm their homeward flight at least 48 hours before departure.

Force Majeure
Except where otherwise expressly stated in these Booking Conditions we regret we cannot accept any liability or pay compensation where the performance of our contractual obiligations is prevented or affected by circumstances and events include war, threat of war, riots, civil strife, or terrorist activity, industrial disputes, natural or nuclear disasterfire, technical problems with aircraft or transport, closure or congestion of airports or ports, bad weather, epidemics or health risks, insolvency of airlines and similar events beyond our control.

Cancellations / Amendments
All confirmed bookings are subject to cancellation charges on a sliding scale. However there is 100% cancellation charge applicable if you have booked a flight either using a low cost airline or a scheduled airline. Please call for exact charges. If you wish to cancel your holiday we require written confirmation from the lead passenger, once we receive this we can begin the cancellation process. It is in your best interest to advise us as soon as possible to avoid heavier cancellation/amendment charges. Some amendments are treated as cancellations and we suggest that you contact Broadway Travel as soon as possible. (N.B Please note some holiday arrangements are non-refundable and non-changeable e.g. scheduled airfares.)

Basis For Contract (subject to English Law)

Broadway Travel Services (Wimbledon) Ltd (company number 472065) trading as broadwaytravel.com and Broadway Travel (“broadwaytravel.com”) whose registered office is at 1 Finway, Luton, LU1 1WE is a sales agent appointed by the owners and/or providers of accommodation and transfer services (“Products”) to sell Products on a non-exclusive basis in the United Kingdom on their behalf to travel agents for onward sale to individuals wishing to use the Products (“Customer(s)”). None of the Products are subject to the Package Travel, Package Holidays of Package Tours Regulations 1992. Broadwaytravel.com accepts no responsibility for the provision of the Product by the Principal. The Principal has a contract with the Customer for the provision of the Product and copies of the terms and conditions of contract are available on request. The Customer makes an offer to buy Product to the Principal which broadwaytravel.com, as agent, are free to accept on behalf of each Principal or to reject it.

We cannot be held responsible for any other travel arrangements that you or your travel agent has confirmed independently and for any costs arising from cancelling or amending these independent arrangements. Once you receive our written confirmation / invoice and accommodation voucher it is essential that you check them for errors or omissions to eliminate any possible misunderstandings. We can not be held responsible if you choose not to check your confirmation / invoice and subsequently find you are booked on something you did not intend and costs maybe involved in changing the arrangements. This is why it is so important to check your confirmation / invoice.

Payments

Descriptions
We decide the ratings given to the accommodation. They conform to the generally accepted understanding of the star system in Britain. This is in order to provide consistency across different countries. These ratings are also based on authoritative guides published in Britain.

We are very careful to ensure that the standard of the accommodation lives up to it's description, but inevitably descriptions of accommodation and the facilities therein are based upon inspections made months in advance. These descriptions are prepared in good faith by overseas representatives and relate to the facilities available at that time. We will endeavour to notify you of any building works before you leave. However this service cannot be provided on late bookings or with accommodation allocated on arrival. We cannot be held responsible for any individual's terms of expression. We are not liable for any information taken from other company's brochures featuring the same properties as that booked with Broadway Travel. In low season it is common that facilities and services may be less widely available both in your accommodation and resort generally. We suggest that you make additional enquiries if any of the above factors cause you concern.

Special Requests
We will wherever possible, endeavour to meet any special requests made in writing to us. However no guarantee can be made. If your special request means additional costs, we will advise you and invoice you for the additional amount.

Travellers under 18

Transfers
No transfers are included in the cost of your booking unless otherwise stated. On arrival at your destination you will normally find taxis just outside the terminal building. You will find that by giving the driver the name of your accommodation and resort, that they should be able to take you straight to your accommodation with minimal delay. PLEASE AGREE A FARE BEFORE YOU TAKE THE JOURNEY. We may be able to offer you an approximate fare but this is not guaranteed and should not be used as a measuring device in terms of distance. In the event that we are providing transfers, this will not normally be provided by your flight operator, therefore, please look for a representative holding a board stating either your name or Beds with Ease, unless otherwise stated.

Unauthorised Occupation
The reservation is valid exclusively to the persons named or numbered on the Broadway Travel accommodation voucher. . Unauthorised occupation may well result in the whole party being asked to vacate the accommodation immediately, either by the accommodation management in resort, or by a Broadway Travel representative. Any client, whose behaviour is deemed to be of annoyance, abuse or causing injury to persons or damage to property, will without cause for compensation have any agreements between themselves and The Company terminated immediately. In the event of the above occurring, the lead client will be held responsible for any extra costs payable to The Company however determined. We reserve the right to invoice the lead client (first named on confirmation/invoice) for these extra costs.

Allocated on Arrival (AOA)
If your booking is one whereby the accommodation name has not been specified, then this will be an Accommodation On Arrival booking. The abbreviation for this will be AOA. Facilities on AOA bookings cannot be guaranteed unless agreed in writing. AOA means that the property will not be allocated to you until either 24 hours prior to departure or upon arrival in the resort, we can therefore not guarantee the position of any property. It may be the case that the keys for your accommodation are held at an office or adjacent property , the details will be printed on your voucher. If you have elected not to take a transfer arranged by Broadway Travel and you have an AOA booking, please ensure that you understand the key collection details fully.

Change of Accommodation
If for any reason beyond our control we have to change your accommodation, The Company reserve the right to offer alternative accommodation of the same or superior rating at no extra cost to the client. Should we only be able to offer lower rated accommodation it is in certain circumstances company practice to offer a discount of up to 10% off the total cost of the new accommodation (insurance and amendments not included). The client has the choice to accept the change with the discounts offered, or to cancel the accommodation reservation without incurring any cancellation charges. If for any reason we are advised of a change of accommodation we will endeavour to advise you either by telephone or in writing. Where this is not possible, we will endeavour to advise you at the earliest opportunity upon arrival at your original accommodation booked. If you wish to alter or amend certain details of your original request an administrative fee of £30.00 per alteration will be made. Within 8 weeks cancellation charges may apply.

Force Majeure

Cancellation
To cancel a reservation or part of, we must receive written and signed confirmation from the lead client. If one or more of the party cancel, the cost to the remaining members of the party may increase to take into account any applicable under occupancy charges. Insurance and amendment charges are not refundable when cancelling. You may be able to claim on your insurance if the claim falls within the terms of the policy. Cancellation charges are charged as a percentage of the total cost.

Insurance (VERY IMPORTANT)
It is entirely your responsibility to ensure that you (or your travel agent) have booked an insurance policy with adequate cover. The Company cannot be held responsible and will not accept any liability for any client travelling either with or without an insurance policy or inadequate cover. Broadway Travel can arrange to offer a fully comprehensive insurance to suit your needs. Insurance cover can be booked at the time of making your reservation. Full details of the cover are available on request. PLEASE DO NOT IGNORE THIS NOTICE.

Complaints
In the unlikely event that you feel that you need to make a complaint it is essential that you follow these guidelines before you return to the UK: Firstly you must advise the reception / accommodation manager immediately as most problems can be eradicated at this point. Your next step is to contact the local representation service. Their details will be found on your accommodation voucher and although they may not be an employee of The Company, they are there to help you and are normally with whom your accommodation is booked via. If your grievance is still unresolved or you are unhappy with the service provided locally, it is a condition of sale that you notify us at Broadway Travel directly. You may also be asked to complete a Customer Complaint Report. It is of the utmost importance that the above procedures are followed as no overseas agent will entertain a claim without first having the opportunity to resolve it. If, on your return to the UK you feel the need to make a formal complaint, you will need to submit in writing the nature of your grievance attaching the signed Customer Complaint Report form to our Customer Services Department in the UK within 28 days of your return. We cannot consider any complaint received outside of this period. In the event of any type of compensation awarded it shall not exceed the total amount paid in respect to the accommodation booked.

Broadway Travel is not liable for any complaints pertaining to your transportation to and from your destination (unless the service is specified as being provided by Broadway Travel) and can only advise you to take up any complaint directly with the provider of that service.

Miscellaneous
You will be asked to vacate your accommodation between 10am and 11am on the date of your departure. Some properties require a refundable security deposit to be taken and you will be liable for any damages. We are not liable for any extensions, upgrades or accommodation extras arranged by the client on arrival in resort.
